Kohima, April 2 (MExN): The Deputy Commissioner of Kohima, B Henok Buchem, has issued an order enforcing strict regulations for pharmacies and medical stores in Kohima district.
The directive is a continuation of an earlier order issued on April 19, 2023, and is in compliance with the Drugs and Cosmetics Act, 1940, as amended through Gazette Notification GSR 588(E) dated August 30, 2023, along with Rule 65 of the Drugs and Cosmetics Rules, 1945, as per the State DIPR.
The directive includes the sale of certain categories of drugs only based on a valid prescription and in the specified quantity, as well as record maintenance for those drugs. (See Box)
It also mandates the inspection of CCTV footage from the last two months.
The order further stated that non-compliance with the directives will attract penal action under Section 152 of the Bharatiya Nyaya Sanhita (BNSS), Section 28A of the Drugs and Cosmetics Act, 1940, and other applicable legal provisions.
All pharmacies and medical stores have been instructed to strictly comply with these regulations to ensure adherence to the law and prevent the misuse of restricted drugs, it added.

1. Sale of Schedule ‘X’, ‘H’, and ‘H1’ Drugs: These restricted drugs shall only be sold based on a valid prescription from a registered medical practitioner and only in the quantity specified in the prescription.
2. Record Maintenance: Pharmacies must maintain a register documenting all sales of the aforementioned drugs, including details of the prescriber, patient, drug, and quantity sold. These records must be preserved for three years and shall be available for inspection.
3. CCTV Footage Inspection: In compliance with the National Commission for Protection of Child Rights (NCPCR) Joint Action Plan, the District Drug Controller Authority and the District Enforcement Force, Kohima, will inspect the CCTV footage of the last two months.
