Sub: - Denial of birth certificate on Religious ground
Respected Madam/Sir,
With due respect and honour I would like to inform that I was out-rightly rejected a birth certificate for my daughter, Zaara Zubi Hussain, born on 20th December 2010 at Nagaland Nursing Home, Dimapur, Nagaland, in India, by one of the staff of the District Registrar of Births and Deaths, under the District Statistical Officer, Naga Shopping Arcade (Super Market), Dimapur, on 5th and 6th of January, 2011, on Religious ground.
Firstly it was on 5th January 2011 when I visited the above mentioned office for the certificate, but the concerned official (the one who enters the name in the certificate) informed me that “Muslims will not get birth certificate from this office, but rather they have to go to Deputy Commissioner’s office (DC), Dimapur.” However, I told the official that I m a Non Naga Indigenous inhabitant of Nagaland and permanently residing at Naharbari village of Dimapur district, Nagaland, in India. But the official insisted that I should go to DC’s office and get the birth certificate from there. So, I obliged and went out of the office on that day. However, I thought of calling the DC on his mobile. After listening to my grievance, the DC said everybody has the right to get birth certificate, however, if the situation demands then you can carry additional documents like local certificate or a resident proof from the respective village’s Gaon Bura (GB).
On the second day, 6th of January 2011, I again went to the above mentioned office with my Non Naga Indigenous Inhabitant certificate and my birth certificate as well. But, the same official again told me to go to DC’s office. This time, I informed the official that the DC told me to carry either local certificate or a resident proof from the respective village’s GB to get the birth certificate, but the official did not comply. The official did not even bothered to see my certificates, but rather insisted on that I should go to DC’s office. I even requested the official to show me the “Order” or “Circular” from the State Government of Nagaland which bans the Muslims from getting their birth certificates in this office and I even asked the official to give me “in written that this office cannot issue birth certificates to Muslims even after producing valid documents.” But the official neither showed me the order nor gave me in written.
Feeling humiliated and discriminated, I decided to go to Media for the open information to the people that such cases of discrimination is still prevalent in the society, where genuine citizens of India are harassed on a daily basis. I would like to mention that “birth certificate denied is education denied.”
As for my family background, I am the great grandson of Late Abdul Gofur, who was the son of Late Haji Ansor Bepari. Late Abdul Gofur was the holder of “Periodic Khiraj Patta No. 1” issued by the then Deputy Commissioner of Naga Hills, Mouza-Dimapur, Mr. JP Mills in the year 1924 and he was once the Mauzadar of Dimapur. These records can be verified from the “Old Chtia Book” from the present DC’s office at Dimapur. Even, my grandfather, Late Nurul Hussain was a government servant in State of Nagaland under the Department of Fisheries as Fishery Officer and my father, Amzed Hussain and my paternal aunt, Nurjahan Begum had recently retired from the Department of Education under Government of Nagaland as teachers. The name of my grandfather, Late Nurul Hussain can be verified in the Dimapur AC Roll 1964, Part DR 6 (Naharbari), District – Kohima, serial number 14 and house number 5. I and my family invite any kind of verification in this regard.
The reason for not issuing the birth certificate even after producing valid documents should be made known to me and rest of the Muslims of Nagaland, and others as well through media.
