Perspective on Disturbed Area Act in Nagaland

Few days ago, it appeared in the local papers that, Nagaland is placed under disturbed Area Act but it appears that, Govt. of Nagaland under the NPF have no concern as to what is happening in the State of Nagaland. Public of Nagaland seems to have lost interest either with Govt. of Nagaland or have lost interest for the lives in Nagaland. Law and order is in the hands of every state under the concurrent list under the Constitution of India for which a state govt must take care of the lives n properties of the citizens of Nagaland.  If a law and order becomes beyond the control of any State then the concerned State have to write to the Union Govt for help and assistance by providing security personnel in order to control the law and order situations. Till such situation arises it is the duty of the State Govt. to see that, the law and order is kept under control. For example. Mr. Vishnu Ram Medhi, the former Chief Minister of Assam had written a letter to Pt. Nehru ji in 1956 for assistance of armed security to maintain the law and order in the region particularly the areas inhabited by the Nagas. Responding to Shri. Medhi’s letter. Pt. Nehru said that, Quote “as I understand it is the military appraisal of the situation. But there is something much more to it than merely the military approach. This Naga troubles and revolts have a larger significance for us in the International sphere. They give a handle to our opponents everywhere more particularly, of course, Pakistan takes advantage of them. In view of our tense situation in regard to Pakistan we have to be wary always and it is unfortunate that, we should be tied up in the Nagas hills etc where some other emergency might have to be faced by us ” Unquote.
This means Nehru was sending armed forces to Naga Hills for military operations. Nehru further advised Shri. Medhi in his same letter which stated, Quote “Nevertheless, there were some little truth in this article (Times of India) and I feel that we have not dealt with this question of the Nagas with wisdom in the past. We must not judge them as we would judge others who are undoubtedly part of India. The Nagas have no such background and sensation and we have to create that sensation amongst them by our good will and treatment. We shall have to think how we can produce this impression and what political steps would be necessary. This may come later of course but the thinking part should begin now onward” Unquote.
His last sentence of his letter to Shri. Medhi stated that, Quote – “I have tried to think loudly in this letter so that I might let you have a glimpse of my mind and I want you to think also and to have talks with your new Governor who have good deal of experiences and can view this question with some wisdom “ Unquote.
Former Chief Minister, Shri. K.L. Chishi and his group pulled down Dr. S.C Jamir’s Ministry which ran for one month and the Govt. was re-toppled by Shri, Vamuzo’s group in collaboration with the Indian National Congress Party with Shri. I. K. Sema as the Deputy Chief Minister but the Govt. of India declared Disturbed Area i.e, 5 kilometres belt along the border of Nagaland. Shri. I.K. Sema in his statement mentioned that, he was not informed and on that ground he resigned from the post of Deputy Chief Minister.
Whether be it afresh declaration and imposition of Disturbed Area Act or an extension of the same Act, it has to be done in consultation with the State Govt. which is clearly enshrined in the Constitution of India.  
Whatever is said and done the past 6 to 7 years was peaceful in the State of Nagaland and can be termed as an Island of Peace. It is not done by the NPF govt. but the NPF Party should think of the Naga peoples co-operation by maintaining peace and tranquillity.
1. Now this NPF govt. loudly pronounced that, Nagaland is an island of peace despite minor incidents here and there and I do agree that the situation is much better than before. If this is the prevailing situation then as to why Nagaland is placed under Disturbed Area Act? What was the question behind it if it is the duty of the Nagaland govt. to explain to the people as to why Disturbed Area was declared in the state of Nagaland otherwise the fear psychosis in the minds of the people will continue?     
2. Whether it is a threat to the Peace Talks taking place between Govt. of India and the NSCN (IM) under the leadership of Chairman, Shri. Issack Chishi Swu and General Secretary, Shri. Th. Muivah?
3. Whether imposition of Disturbed Area Act or an extension of the same Act, why the Govt. of India do not involve the State Govt. If it is so, it is totally unconstitutional and it is simply a misuse of power without following the rightful position of the Constitution of India in the entire country.
4. The imposition or continuation of the Disturbed Area Act was done by a    Committee or just an imposition by the Govt of India and Home Ministry, such action of the Govt. of India makes one to ponder over the improper implementations of the Constitutional provisions. If there is no such Committee then the Govt. of India should have such relevant Committee not only for Nagaland but also for other States like Assam, Meghalaya, Tripura, Arunachal Pradesh, Manipur, West Bengal, and others. If there is such a competent Committee in the Union Govt. to study such problem, then it can be termed as un-constitutional and dictatorial manner of administration and governance.
Both the Union Govt. and the State Govt. of Nagaland must understand that, administration is for the human beings and the citizens welfares is to be looked after by the Govts. but not to destroy peace and harmony. Every individual is a citizen of the Country and it is the duty of the govt. to protect and safeguard every citizen within the territory and it is the duty of the govt. to deliver good will and welfares of the people.
