The Kohima Bench of the Gauhati High Court has admitted an intra-court appeal raising a legal question on whether the Nagaland Information Commission (NIC) has the statutory authority to modify or amend its own orders.
A Division Bench of Justices Kalyan Rai Surana and Sanjeev Kumar Sharma, while hearing the matter on May 6, observed that the core issue in the appeal is whether the Commission is vested with such powers under the relevant statutory provisions.
The appeal arose from an RTI matter in which the appellant had initially approached the Commission after being aggrieved by a decision of a Public Information Officer.
The Commission had passed an order on April 28, 2023. However, following an application filed by the Public Information Officer and the Deputy Secretary of the State Agriculture Department seeking modification, the Commission subsequently altered its earlier order on May 22, 2023.
Challenging the legality of that modification, the appellant moved the Division Bench, challenging a judgment passed by a single-judge of the Court on August 5, 2025.
Taking note of the legal issue involved, the Bench admitted the appeal for hearing and issued rule returnable forthwith.
