A consultative meeting on the implementation of the Rules for Administration of Justice and Police in Nagaland (Fifth Amendment), 2025 was held at the Deputy Commissioner Chamber, Zunheboto, on June 4.
During the deliberations, Deputy Commissioner Zunheboto, Dharam Raj, IAS highlighted the importance of thoroughly examining the provisions of the Act and identifying areas that may require further clarification. He elaborated on the three-tier customary court system comprising the Village Customary Court, Subordinate Customary Court and District Customary Court.
The DC also emphasised the need for clear delineation of powers and responsibilities among the different levels of customary courts. He noted that serious criminal offences continue to be dealt with under the regular judicial system and stressed the importance of ensuring that customary courts function within the scope provided by law.
The meeting further discussed issues relating to jurisdiction, including inter-village, inter-tribal and inter-district matters, and the need for greater clarity in addressing such cases under the existing framework.
Dr Kupe Kapfo, Superintendent of Police, Zunheboto, also shared his views during the consultation and underscored the importance of customary courts primarily addressing civil and community-related matters at the village level. He stressed the need for clear guidelines on the nature of cases that may be taken up by Village, Subordinate and District Customary Courts while ensuring fairness and adherence to legal principles.
Participants also discussed the need for greater sensitization and awareness regarding the provisions of the customary court system. The codification of customary laws and the maintenance of proper records by customary courts were among the key issues highlighted during the meeting.
The consultative meeting was attended by officials from the district administration, police department, District Dobashis, representatives of Zunheboto Town GBs and other stakeholders.
