
Dimapur, March 22 (MExN): One of the claimants of a plot of land in Burma camp, Dimapur, in the news for a fracas on March 18 today issued a counter statement to allegations stated in an FIR lodged against him. Zasivikho Zakiesato, one of those named in a counter-FIR against him, disclaimed allegations in the counter-FIR lodged against him by his aunt one Avino.
In his statement, Zasivikho said he is the only legal heir of the plot of land. He stated that Avino and his uncle secretly connived and obtained “jamabandi patta” by “misleading the revenue authority DC office Dimapur” and “without following the process as laid down under Assam Land and revenue regulation Act.” On the basis of the “jamabandi patta” obtained illegally, the statement said, the aunt and her husband Sashisangba “attempted to forcibly occupy the disputed land as rightful owner.”
Zasivikho said that on the morning of March 18 when they came to the plot, he asked them to refrain from the “illegal activity” but they refused. However, with the intervention of family members both the sides mutually agreed to stop any activity on the land till settlement, the statement said. However, Sashisangba and “some of his people” “came to occupy the disputed land again”. It is Sashisangba “who came with ulterior motive” with about 12 people and “provoke me and my family” the statement said.
“When I approached them to stopped work as agreed in the morning, Sashisangba threw plat containing rice all over my body and charged me along with his men thereafter I informed my family member who later came to pacify the matter but even my family members five of us, two uncles namely Ngucha and Sakho of Khagino clan and two brothers were physically assaulted” the statement asserted.
He also asserted, “Ngucha and two brothers were beaten up by Sashisangba and his men who are also under medical treatment.” The “accused”, Zasivikho stated, also “attempted to kill me by throwing the cow bar (jamphol) however it missed and unfortunately kill late Shri Vihoto.” The incident was witnessed by “many people present there including colony people and those present in the church adjacent to the site of the incident and from their statement it is also evident that the accused Sashisangba took time, aimed with an intention to kill, threw the cowbar.”
The statement further said that when Zasikvikho filed an FIR against Sashisangba and arrested, Avino “requested me and my family and also used all pressure tactic to withdraw the FIR against Sashisangba.” When he refused, the statement stated, Avino filed a counter-FIR “me and my clan members” to “coerce us to withdraw the FIR against her husband.” The statement said that the incident may be verified from “any colony people.”
He stated that on earlier occasions he has been threatened on many occasions over phone and have filed FIR ‘which is pending investigation.’
He also denied ‘raising my hand’ on his aunt and called it “totally false and she being my aunty and under any circumstances, raising hand on my aunty does not arise.”
“The family dispute with regard to land does not justify commission of any criminal act to the extend of killing someone, therefore aunty Smt. Avino may refrain from defending herself and the criminal act of her husband by making false allegations against me and my family,” the statement added.
