NDEEFWA expresses concern over bypassing rules

Kohima, May 17 (MExN): The Nagaland Diploma Electrical Engineering Field Worker’s Association (NDEEFWA) today stated that the standing Nagaland Engineering Service Rules made in the exercise of the power conferred under Article 309 of the Constitution of India clearly provides for 10 % reservation for promotion to the post of Junior Engineer to incumbents having 3 years diploma in the concerned engineering,” however, inspite of such provision and intermittent representation to the government, the same have not been considered.
Stating that the total number of the post of Junior Engineer under power department is 141, the Association said “Therefore, we are entitled to fill up 14 posts of Junior Engineer in as much as 10% of 141 post is 14.”  The Association added that it was observed with much discontent that 6 Junior Engineer have been appointed illegally on contract basis, “depriving us of our due promotion and two more post have fallen vacant due to promotion to the post of SDO.”
The Association once again reminded that “our legal rights have been infringed and denied miserably as such, unless promotion in accordance to the provision of the said Rules is provided to us, we concertedly made it clear that we will take the matter to the court of law for justification.” Any executive actions, orders or exercise in contravention to the Rules made under Article 309 cannot sustain in the eye of law,” the Association said in a release today.
